Below are the terms of service for Ranching.FYI and its related public forums. Please also read our Rules for Content before posting on our site. 

The services offered by Ranching.FYI ("Ranching.FYI," "we," “us” or “our”) include the Ranching.FYI website, the Ranching.FYI internet forums (the “Forums”), and any other features, content, or application offered from time to time by Ranching.FYI in connection with the website (collectively, the “Website”). Ranching.FYI is privately owned and hosted in the United States. Ranching.FYI is an informational and networking service that allows Users (as defined below) to read informational articles and participate in internet forums related to ranching, the business of ranching, and the lifestyle of ranching.

 
This Terms of Use Agreement ("Agreement") sets forth the legally binding terms for your use of Ranching.FYI. By using Ranching.FYI, you agree to be bound by this Agreement, whether you are a "Visitor" (which means that you simply browse the Website) or you are a "Member" (which means that you have registered with Ranching.FYI). The term "User" refers to a Visitor or a Member. You are authorized to use Ranching.FYI (regardless of whether your access or use is intended) only if you agree to abide by all applicable laws and to this Agreement. Please read this Agreement carefully and save it. If you do not agree with it, you should leave Website and discontinue use of Ranching.FYI immediately. If you wish to become a Member, you must read this Agreement and your Registration process indicates your acceptance.

 
This Agreement includes our policy for acceptable use of Ranching.FYI and Content posted on the Website, your rights, obligations and restrictions regarding your use of Ranching.FYI and Ranching.FYI’s Privacy Policy.

We may modify this Agreement from time to time, and such modification shall be effective upon posting by Ranching.FYI on the Website. You agree to be bound to any changes to this Agreement when you use Ranching.FYI after any such modification is posted. It is therefore important that you review this Agreement regularly to ensure you are updated as to any changes.

Eligibility: Use of and Membership in Ranching.FYI is void where prohibited. By using Ranching.FYI, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 18 years of age or older; and (d) your use of Ranching.FYI does not violate any applicable law or regulation.

 
Term: This Agreement shall remain in full force and effect while you use Ranching.FYI or are a Member. You may terminate your Membership at any time, for any reason, by visiting https://ranchingfyi.community.forum. As stated above, we may terminate your Membership at any time, without warning. Even after Membership is terminated, this Agreement will remain in effect.

 
Fees: The Website may be used by all personal and business users free of charge. Ranching.FYI may offer enhancements and features to registered Members for a fee. You may at any time cancel your Membership as described above. If you terminate your membership within the last 5 days of a calendar month, then your subscription will terminate as of the end of the next calendar month; otherwise, your subscription will end at the end of the current month. For example, if you had a monthly subscription and terminated on April 25th, then your subscription would end on the last day of May and you would be charged for the month of May. Membership fees, once paid, are not refundable under any circumstances.

 
Password: When you sign up to become a Member, you will be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another Member at any time or to disclose your password to any third party. You agree to notify us immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account. 

Non-commercial Use by Members: Ranching.FYI’s services are for the personal use of Members only, and Content may not be used in connection with any commercial endeavors except those that are expressly permitted by us (e.g., our paid advertisers). Illegal or unauthorized use of Ranching.FYI, including collecting usernames or email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the Website is prohibited. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from the Forums without notice and may result in termination of Membership privileges. We may take legal action with respect to illegal or unauthorized use of Ranching.FYI.

 
Proprietary Rights in Content on Ranching.FYI: We do not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, or any other materials that you post to Ranching.FYI (collectively, "Content"). After posting your Content to Ranching.FYI, as between you and us, you continue to retain all ownership rights in such Content, and you continue to have the right to use your Content in any way you choose. By displaying, publishing or posting any Content, you hereby grant to us a fully-paid, royalty-free, irrevocable, limited license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content solely on and through Ranching.FYI.

 
The license you grant to us is non-exclusive (meaning you are free to license your Content to anyone else in addition to us), fully-paid and royalty-free (meaning that Ranching.FYI is not required to pay you for the use on Ranching.FYI of the Content that you post), sub-licensable (so that we are able to use our affiliates and subcontractors, such as Internet content delivery networks, to provide Ranching.FYI), and worldwide. This license will terminate at the time you remove your Content from Ranching.FYI. The license does not grant us the right to sell your Content, nor does the license grant Ranching.FYI the right to distribute your Content outside of Ranching.FYI.

 
You represent and warrant that: (i) you own the Content posted by you on or through Ranching.FYI or otherwise have the right to grant the license set forth in this section, and (ii) the posting of your Content on or through Ranching.FYI does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. You agree to pay for all royalties, fees, and any other monies owing to any person by reason of any Content posted by you to or through Ranching.FYI.

 
Ranching.FYI also contains our own content, designs and creations that we provide on or post to Ranching.FYI, including from our paid content contributors, subject matter experts, and volunteer contributors ("Ranching.FYI Content"). Ranching.FYI Content contains opinions, observations, practices and other information that is provided for you to evaluate and use and follow, if at all, as you deem best under your particular circumstances. The Ranching.FYI Content is not intended to be, and should not be treated as, legal advice or financial planning advice. Please see Disclaimers below for additional information about the Ranching.FYI Content.

Ranching.FYI Content is protected by copyright, trademark, patent, trade secret and other laws, and Ranching.FYI owns and retains all rights in the Ranching.FYI Content and Ranching.FYI. Ranching.FYI hereby grants you a limited, revocable, non-sub-licensable license to reproduce and display the Ranching.FYI Content (excluding any software code) solely for your personal use in connection with viewing the Website and using Ranching.FYI.

 
Content Posted: We may delete any Content that we believe, in our sole judgment, violates this Agreement or is otherwise prohibited content or activity. We assume no responsibility for monitoring Ranching.FYI for inappropriate Content or conduct. If at any time we choose, in our sole discretion, to monitor Ranching.FYI, we nonetheless assume no responsibility for the Content, no obligation to modify or remove any inappropriate Content, and no responsibility for the conduct of the User submitting any such Content.

You are solely responsible for the Content that you post on or through any Ranching.FYI, as well as any material or information that you transmit to other Members and for your interactions with other Users.

 
We do not endorse and have no control over your Content or the Content of other Users or Members. Content is not necessarily reviewed by Ranching.FYI prior to posting and does not necessarily reflect the opinions or policies of Ranching.FYI. We make no warranties, express or implied, as to the Content or to the accuracy and reliability of the Content or any material or information that you post or that other Members or Users post.

 
Content/Activity Prohibited: We reserve the right, in our sole discretion, to reject, refuse to post or remove any posting by you, or to restrict, suspend, or terminate your access to all or any part of Ranching.FYI at any time, for any or no reason, with or without prior notice, and without liability. We also reserve the right to restrict, suspend, or terminate your access to any part of Ranching.FYI for any or no reason, with or without prior notice, and without liability.

The following is a partial list of the kind of Content that is prohibited to post on or through Ranching.FYI. We reserve the right to investigate and take appropriate legal action against anyone who, in our opinion and sole discretion, violates this provision, including without limitation, removing the offending communication from Ranching.FYI and terminating the Membership of such violators. Prohibited Content includes, but is not limited to, Content that, in our sole discretion, we believe:

• is patently offensive;

• promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;

• harasses or advocates harassment of another person;

• contains nudity, violence, or offensive subject matter or contains a link to an adult website;

• solicits personal information;

• promotes information that is false or misleading;

• promotes illegal activities;

• is defamatory or libelous; or

• involves commercial activities and/or sales without our prior written consent such as, but not limited to contests, sweepstakes, barter, advertising, or pyramid schemes;

Please choose carefully the information you post on Ranching.FYI and that you provide to other Users. Despite these prohibitions, information provided by other Ranching.FYI Users may contain inaccurate, inappropriate, offensive or sexually explicit material, products or services, and we assume no responsibility or liability for this material. If you become aware of misuse of Ranching.FYI by any person, please contact us via email at ranching.FYI@gmail.com.

Copyright Policy: You may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. You represent and warrant that you are the copyright owner of, or have the right to reproduce, any material you post on Ranching.FYI (including the Forums).

 
Member Disputes: You are solely responsible for your interactions with other Ranching.FYI Members or Users. We reserve the right, but have no obligation, to monitor disputes between you and other Members or Users.

 
Disclaimers: We are not responsible for any incorrect or inaccurate Content posted on the Website or in connection with Ranching.FYI, whether caused by Users or Members of Ranching.FYI or by any of the Ranching.FYI Content. The Ranching.FYI website, forums, and Ranching.FYI Content, including content provided by Users, Members, or Ranching.FYI or its paid or volunteer content contributors, is provided "AS-IS" and as available, and we expressly disclaim any warranty of fitness for a particular purpose or non-infringement. We cannot guarantee and do not promise any specific results from use of Ranching.FYI.

We are not responsible for the Content, accuracy or opinions expressed on third-party websites that you might access via a link posted by Members or Users, and such websites are in no way investigated, monitored or checked for accuracy or completeness by Ranching.FYI. Inclusion of any linked website on Ranching.FYI does not imply approval or endorsement of the linked website by Ranching.FYI. When you access these third-party sites, you do so at your own risk.

We are not responsible for third party advertisements which are posted on the Website or through Ranching.FYI, nor are we responsible for the goods or services provided by our advertisers.

We are not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any User or Member communication. We ae not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or on any of Ranching.FYI or combination thereof, including any injury or damage to Users or Members or to any person's computer related to or resulting from participation or downloading materials in connection with Ranching.FYI.

Limitation on Liability: IN NO EVENT SHALL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US FOR RANCHING.FYI DURING THE TERM OF MEMBERSHIP.

Disputes: If there is any dispute about or involving Ranching.FYI, you agree that the dispute shall be governed by the laws of the State of Wyoming, USA, without regard to conflict of law provisions, and you agree to exclusive personal jurisdiction and venue in the state and federal courts of the United States located in the State of Wyoming.

 
Indemnity: You agree to indemnify and hold Ranching.FYI, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of Ranching.FYI, including (without limitation) your use of Ranching.FYI in violation of this Agreement, arising from your breach of this Agreement, any breach of your representations and warranties set forth above, any Content that you post on the Website or through Ranching.FYI, that causes us to be liable to another.

 
Other: This Agreement is accepted upon your use of the Website or any of Ranching.FYI and is further affirmed by you becoming a Member. This Agreement constitutes the entire agreement between you and Ranching.FYI, LLC, regarding the use of Ranching.FYI. Our failure to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. The section titles in this Agreement are for convenience only and have no legal or contractual effect. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.
